1. By clicking the “Free Sign Up” button and requesting an e-mail address from coolkiwi.co.nz (“We, Us, Our”), you (“You, Your”) agree and acknowledge that Your use of Our e-mail diversion service (“the Service”) is governed by the following terms and conditions.

2. You warrant that You have the necessary authority to divert messages from your coolkiwi.co.nz e-mail address to the diversion addresses You provide either at the time You sign up or subsequently. You also warrant that you are 18 (eighteen) years of age or older at the time of signup. You shall indemnify Us against all claims, actions, losses, liabilities and costs arising out of Your breach of this warranty.

3. You warrant that You shall at all times use the Service for lawful purposes only, and You shall indemnify Us against any claims, actions, losses, liabilities and costs arising out of Your use of the Service, including, but not limited to, use of the Service to propagate SPAM or other illegal or unlawful material, or for any denial of service events.

4. The Service is made available to You completely Free in return for creating a Free profile upon Approval of your Free coolkiwi.co.nz Address, with our Free New Zealand Friendship network NZFriendfinder.com

5. Coolkiwi.co.nz is a very reliable service with backup servers and load balancing to ensure reliable delivery of your emails. We shall use reasonable endeavours to ensure that the Service remains fully operational, but shall have no liability to You in the event of any disruption howsoever caused.

6. We may terminate Your use of the Service (a) at any time on giving You reasonable notice; (b) immediately in the event of any breach of these terms and conditions by You.

7. We may refuse to sign You up for the Service for any reason, including, without limitation, (a) failure by You to provide required information either accurately or at all, (b) failure to create a Free Profile as required in return for use of this free email service, or (c) the requesting of addresses which contain words of an obscene or offensive nature. In the event that your free email address has already been activated we may also terminate your service for any of the above reasons.

8. You may terminate Your use of the Service at any time on giving notice to Us by sending a Notice of Cancellation to support@coolkiwi.co.nz from the email address you have supplied to us.

9. In the event of termination under 6(a) 6(b) or 7(a) 7(b) or 7(c), We shall be under no obligation to provide any further services to you.

10. You may update the email address where you receive your coolkiwi.co.nz emails by advising us via email to support@coolkiwi.co.nz from the email diversion address you originally supplied us, and quoting your existing coolkiwi.co.nz email address.

11. We may occasionally contact You at the email account you have supplied in order to notify you of changes, updates or news affecting your coolkiwi.co.nz email service and/or associated services. However, such contact shall be minimul, and not normally exceeding a maximum of one (1) contact per month except in exceptional circumstances (such as urgently necessary member service notifications.)

12. Our total liability to You for the provision of the Service, whether in contract, tort or otherwise shall not exceed the total sums paid by You, which as this is now a free service will generally be nothing.
